The following terms and conditions apply to the website and services offered by Bringo Express. This includes any version of Bringo Express accessible via desktop, mobile, tablet, social media or other devices.

By using the website and services, you agree to be bound by these terms and conditions and our privacy policy. In these terms and conditions, the words "website", refer to Bringo Express’ website, "we", "us", "our", and "Bringo Express", refer to Bringo Express, and “customer”, and "user", refer to you, the user or customer of Bringo Express.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OR OBTAINING ANY INFORMATION OR SERVICES FROM THE WEBSITE.

 

1. ACCEPTANCE OF TERMS

This agreement sets forth the legally binding terms for your use of the website and services offered by Bringo Express. By accessing and using the website and its services, you agree to abide by the provisions of this agreement. If you do not agree to these terms, you must refrain from using the website and services. We reserve the right to modify this agreement at any time, and such modifications shall be effective upon posting on the website. By continuing to use the website and services following the posting of any modifications, you agree to be bound by the updated terms; therefore, it is important that you review this agreement periodically.

Bringo Express reserves the right, in its sole discretion, to refuse to provide services to any user or customer and to modify its eligibility criteria at any time. This provision shall be inapplicable in those jurisdictions where it is prohibited by law and, in such cases, the right to access the website and services will be revoked.

By using the website and services, you represent and warrant that you have full power, authority and capacity to enter into this agreement and to perform all obligations hereunder. You further represent and warrant that you are not subject to any legal incapacity or contractual restriction that would prevent you from entering into this agreement.

 

2. NOTIFICATIONS AND NEWSLETTER

By providing Bringo Express with your e-mail address, you agree that we may use your e-mail address to send you important notifications and communications about our services, news and special content. If you do not wish to receive these e-mails, you may opt-out of receiving them by sending us your request through our contact information or by using the "unsubscribe" option in the e-mails themselves. This option may prevent you from receiving emails about our services, important news and special content.

3. ACCOUNT

To facilitate the use of our services, users may register and create an account by completing the registration form available on the website. You are responsible for maintaining the confidentiality of your password and account information and are fully responsible for any and all activity that occurs under your account. By registering, you agree to:

 

(a) immediately notify Bringo Express of any unauthorized use of your account or password, or any other breach of security, and (b) ensure that you sign off at the end of each use. You may not use another user's account without prior authorization from Bringo Express. Bringo Express will not be liable for any loss or damage resulting from your failure to comply with these obligations.

Users may cancel their account at any time and for any reason from the account settings or by sending us a request through our contact details. Cancellation will result in the deletion of the account and the deletion of all associated personal data transferred to Bringo Express.

Bringo Express reserves the right to suspend or terminate your account or access to the website immediately, with or without notice, and without liability, if it believes that you have violated any of these terms.

 
4. MERCHANDISE RECEIVING AND SHIPPING PROCESS

Bringo Express services allow the customer to purchase items from various online stores, such as Amazon, eBay, among others, and ship them to any of our strategically located warehouses in the USA, UK, France and China. Each warehouse is staffed with trained personnel to receive the packages and ensure that they meet quality and weight requirements. Once the item arrives at the warehouse, Bringo Express will inspect the physical condition of the package, weigh and repackage it to ensure a safe and, in many cases, more economical shipment.

Bringo Express will send a notification to the customer that the item has been received. This notification will include the tracking number and corresponding invoice. This information will be sent via the means of communication selected by the customer, either WhatsApp or SMS, to ensure immediate receipt of the information.

 

5. SHIPPING OPTIONS AND DELIVERY TIMES

At Bringo Express we offer a wide variety of shipping options to meet different needs and priorities. Our shipping services include:

  • Express Shipping: This method is ideal for those who need to receive their goods quickly. Delivery times are usually shorter and priority is given to these packages during transportation logistics.

  • Standard Shipping: A more affordable option for those who do not have urgency in delivery. The delivery time is longer compared to express shipping, but guarantees the same quality of protection and delivery of the items.

  • Consolidated Shipping: For those who wish to reduce shipping costs, Bringo Express offers the option of consolidation, allowing the customer to group several packages and ship them together. This reduces shipping costs and minimizes the risk of loss of individual packages.

It is important to note that delivery times may vary depending on the destination of the package, the shipping method selected, customs regulations, as well as other factors beyond our control, such as adverse weather conditions and strikes. Bringo Express will make every effort to keep customers informed of any unexpected delays.

6. SHIPPING AND CUSTOMS CLEARANCE COSTS

Bringo Express is responsible for shipping costs in most cases under the DDP (Delivered Duty Paid) Incoterm, which includes door-to-door delivery of the package. This means that customers do not have to worry about customs clearance or paying duties on most shipments.

However, for items with a value of more than USD 300, additional customs fees may apply, ranging from 25% to 35% of the invoice value issued by the merchant. Such fees are the sole responsibility of the customer, and Bringo Express will provide all necessary documentation and support to enable the customer to make payment of these fees. In the event that the customer fails to make the required payment, the package may be retained by the customs authority or returned to the sender, and all additional costs will be borne by the customer.

 

7. PAYMENTS

To process payments for the services provided by Bringo Express, we use a secure payment platform called Maxicash, which facilitates the use of credit or debit cards, as well as access to local mobile money services. Maxicash is designed to ensure maximum security for our customers' transactions, applying advanced encryption and fraud protection methods. Bringo Express does not directly store or process users' financial information, as this is handled entirely through the secure payment gateway.

The Customer must make payment for shipping services before Bringo Express can proceed with the shipment of their goods. The total amount due includes shipping costs and any additional fees, such as customs charges that may apply for specific items. In the event that additional fees apply, the customer will be informed in advance in order to make the corresponding payment.

A “Cash on Delivery” (COD) option is also available, subject to the approval of the Bringo Express team. This payment method will only be available to customers who have demonstrated a reliable payment history and have the explicit consent of Bringo Express. The Customer should understand that the Cash on Delivery option may incur an additional charge for handling the service, and will be subject to risk assessment by our team.

In the event that a payment is not processed correctly or the customer does not complete the payment required for a shipment, Bringo Express reserves the right to suspend shipment of the item and/or hold the package in our warehouses until payment is completed in full. Items held for non-payment will be subject to additional storage fees, which will be notified to the customer in a timely manner.

Bringo Express reserves the right to change the rates for its services at any time. Any changes in rates will be communicated in advance to the customers, who will have the opportunity to review and accept the changes before placing new orders. Applicable rates will be those in effect at the time payment is made for the services contracted.

All fees charged by Bringo Express will be in the currency specified on the platform and must be paid in the same currency. If the customer uses a credit/debit card that operates in a different currency, any difference due to exchange rate fluctuations or additional fees imposed by the customer's bank will be the sole responsibility of the customer.

8. PROHIBITED ITEMS

To comply with international regulations and to ensure the security of all our shipments, Bringo Express does not carry certain items. These include, but are not limited to:

  • Prohibited or Controlled Substances: Illegal drugs, psychotropic substances and any materials prohibited by local or international laws.

  • Flammable or Hazardous Products: Explosives, fuels, radioactive materials and any item considered a safety hazard during transportation.

  • Perishable Materials: Fresh food, agricultural products, live animals or other perishable goods requiring special transportation conditions.

  • Arms and Ammunition: Pistols, rifles, ammunition and any firearms components.

  • Items of Cultural or Historical Value: Archaeological artifacts, works of art of high cultural value and other items whose trade is restricted by law.

  • Stolen or Illegal Intellectual Property Materials: Counterfeit products, pirated goods or any items that violate intellectual property rights.

Customers are responsible for ensuring that their items are not on this list. In the event that a prohibited item is detected during inspection, Bringo Express reserves the right to refuse shipment and, where appropriate, notify the relevant authorities.

 

9. REPACKING AND LIABILITY FOR DAMAGE

The Bringo Express team strives to repack all items received in a proper manner, using high quality materials and following procedures that minimize the risk of damage in transit. However, Bringo Express recommends that customers consider taking out insurance for their shipments, especially if high value items are involved.

Bringo Express is not responsible for any damage that may occur during transport if the items were properly repackaged and complied with all standard protective measures. If the customer notices any obvious damage to the package received, he/she must notify Bringo Express within 24 hours of receipt, providing photographic evidence and any other required documentation. Bringo Express will review the claim and make every effort to find a fair solution.

10. DANGEROUS GOODS AND INTERNATIONAL REGULATIONS

Bringo Express undertakes to strictly comply with international regulations regarding the transportation of goods. All shipments are subject to the regulations set forth by the countries of origin and destination, as well as international transportation conventions. Consequently, dangerous or restricted items will be subject to additional checks and may be refused for shipment.

Bringo Express also reserves the right to refuse any shipment that it deems hazardous or that may pose a risk to transportation safety, public health or the environment. Customers who attempt to ship restricted items without proper notification may be liable for legal penalties and any costs resulting from non-compliance.

 

11. LIMITATION OF LIABILITY

Bringo Express provides freight forwarding, repacking and logistics management services, acting as an intermediary between customers and warehouses and carriers for the delivery of purchased goods. While we strive to ensure the quality, safety and efficiency of our services, there are limitations to our liability that customers should be aware of.

Bringo Express will not be liable for any damage, loss or delay that may occur during the transportation of goods, provided that the goods have been repackaged in accordance with safety standards and using appropriate materials. Customers are advised to take out transportation insurance to protect their shipments, especially in the case of high value items. The Customer agrees to assume the risk of any loss or damage to shipments without insurance coverage.

Delivery times provided by Bringo Express are estimates and are subject to possible delays due to circumstances beyond our control, such as: adverse weather conditions, customs delays, force majeure events, strikes or problems with contracted third party carriers. Bringo Express will not be liable for any losses, damages or additional costs resulting from these delays. We undertake to inform the customer as soon as we are notified of any circumstances affecting delivery times, but the customer accepts that Bringo Express does not guarantee exact delivery times.

Bringo Express will not be liable for any errors made by the original seller or merchant in connection with the items purchased. This includes, but is not limited to, defective products, products that do not meet the description provided by the seller, errors in the quantity or quality of items, and counterfeit or inauthentic products. Any claims for these reasons should be directed to the relevant seller, and Bringo Express will not act as a mediator in disputes between the customer and the seller.

In the event that a package is detained or confiscated by customs authorities or other governmental agencies, Bringo Express will not be liable for any associated costs, losses or delays. The Customer is responsible for ensuring that the items shipped comply with all import and export regulations of the destination country, and for bearing any additional charges imposed by customs authorities, including fees, taxes or fines.

Bringo Express shall not be liable for any consequential, incidental, special or punitive damages that may arise from the use of our services, even if we have been advised of the possibility of such damages. This includes, but is not limited to, economic loss, loss of revenue, loss of profits, loss of business opportunities or any other indirect damages.

The total liability of Bringo Express shall, in any event, be limited to the amount paid by the customer for the relevant shipping service. This limitation of liability shall apply to the fullest extent permitted by law and shall not affect the rights of the customer which cannot be excluded by applicable law.

By using Bringo Express services, the Customer accepts and acknowledges these limitations of liability, and understands that Bringo Express makes no express or implied warranty as to the quality, accuracy or timeliness of the service, beyond what is set forth in these terms and conditions.

12. COPYRIGHT

All content on Bringo Express website, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, software and other items are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Bringo Express or by third parties who have licensed or provided their material to the website. You acknowledge and agree that all materials on Bringo Express are made available for limited, non-commercial, personal use only. Except as specifically provided herein. No material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without Bringo Express prior express written permission. You may not add, delete, distort, or otherwise modify the material. Any unauthorized attempt to modify any material, to defeat or circumvent any security features, or to utilize Bringo Express or any part of the material for any purpose other than its intended purposes is strictly prohibited.

 

13. COPYRIGHT INFRINGEMENT

Bringo Express will respond to all inquiries, complaints and claims relating to alleged infringement by breach or violation of the provisions contained in international and DRC intellectual property and copyright laws and regulations. Bringo Express respects the intellectual property of others and expects users to do the same. If you believe, in good faith, that any material provided on the Bringo Express website infringes your copyright or other intellectual property rights, please submit your request via our contact information, with the following information:    

  • Identification of the intellectual property right that is allegedly infringed. All relevant registration numbers or a statement regarding ownership of the work should be included.

  • A statement that specifically identifies the location of the infringing material, in sufficient detail so that Bringo Express can find it on the website. 

  • Your name, address, telephone number and email address.

  • A statement by you that you have a good faith belief that the use of the allegedly infringing material is not authorized by the copyright owner, or its agents, or by law.

  • A statement by you, made under penalty of perjury, that the information in your notification is accurate, and that you are the copyright owner or authorized to act on its behalf.

  • An electronic or physical signature of the copyright owner or of the person authorized to act on the copyright owner's behalf.

15. PROHIBITED ACTIVITIES

The following activities are prohibited:

  • Violate the restrictions in any robot exclusion headers on the services or bypass or circumvent other measures employed to prevent or limit access to the services.

  • Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure.

  • Deep-link to any portion of the services for any purpose without our express written permission.

  • "Frame", "mirror" or otherwise incorporate any part of the website into any other websites or service without our prior written authorization.

  • Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by Bringo Express in connection with the services.

  • Circumvent, disable or otherwise interfere with security-related features of the website or features that prevent or restrict use or copying of any content.

 

16. DISCLAIMER OF WARRANTIES

Due to the nature of the Internet, Bringo Express provides and maintains the website on an "as is", "as available" basis and does not promise that use of the website will be uninterrupted or error free. We will not be liable to you if we are unable to provide the website or our services for any reason beyond our control.

Our website may from time to time contain links to other websites which are not under the control of and are not maintained by us. These links are provided for your convenience only and we are not responsible for the content of those sites.

Except as provided above we can give no other warranties, conditions or other terms, express or implied, statutory or otherwise and all such terms are hereby excluded to the maximum extent permitted by law.

You will be responsible for any breach of these terms by you and if you use the website in breach of these terms you will be liable to and will reimburse Bringo Express for any loss or damage caused as a result.

Bringo Express shall not be liable in any amount for any failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control, including, without limitation, Internet outages, communications outages, fire, flood, war or any uncontrollable act of nature.

These terms do not affect your statutory rights as a consumer which are available to you.

Subject as aforesaid, to the maximum extent permitted by law, Bringo Express excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Bringo Express and Bringo Express shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

  • Any incorrect or inaccurate information on the website.

  • The infringement by any person of any Intellectual Property Rights of any third party caused by their use of the website or service purchased through the website.

  • Any loss or damage resulting from your use or the inability to use the website or resulting from unauthorized access to, or alteration of your transmissions or data in circumstances which are beyond our control.

  • Any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

  • Any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing or using content from the website or from transmissions via emails or attachments received from Bringo Express.

  • All representations, warranties, conditions and other terms which but for this notice would have effect.

17. ELECTRONIC COMMUNICATIONS

Bringo Express will accept no liability for failed, partial or garbled computer transmissions, for any breakdown, failure, connection, availability of computer, telephone, cable, network, electronic or Internet hardware or software, for the acts or omissions of any user or third party, for the accessibility or availability of the Internet or for traffic congestion or unauthorized human action, including errors or mistakes.

 

18. INDEMNIFICATION

You agree to defend and indemnify Bringo Express from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

  • Your breach of this agreement or the documents referenced herein.

  • Your violation of any law or the rights of a third party.

  • Your use of the website and services.

 

19. CHANGES AND TERMINATION

We may modify the website and these terms at any time, at our sole discretion and without notice. You are responsible for keeping yourself informed of these terms. Your continued use of the website constitutes your acceptance of any changes to these terms and any changes will supersede all previous versions of the terms. Unless otherwise specified, all changes to these terms apply to all users and customers. In addition, we may terminate our agreement with you under these terms at any time by notifying you in writing (including by email) or without notice.

 

20. INTEGRATION CLAUSE

This agreement together with the privacy policy and any other legal notices published by Bringo Express, shall constitute the entire agreement between you and Bringo Express concerning and governs your use of the website and the services.

21. FORCE MAJEURE

Bringo Express shall not be liable for any failure or non-performance of services due to causes beyond its reasonable control, including but not limited to acts of civil authorities, acts of military authorities, riots, acts of nature and natural disasters, and other acts which may be due to unforeseen circumstances and which may prevent the performance of our services.

22. ARBITRATION

You acknowledge and agree that any dispute, claim or controversy arising out of or relating to these terms and conditions, whether for breach, termination, performance, interpretation or validity, as well as any aspect of your use of the website and our services, shall preferably be resolved by binding arbitration between you and Bringo Express. Notwithstanding the foregoing, the right of both parties to bring individual claims in a court of competent jurisdiction if they deem it necessary remains.

In the event of any dispute arising in connection with your use of the website and our services or breach of these terms and conditions, both parties agree to seek resolution through an arbitration process. This process will be conducted before a recognized and respected arbitration entity, selected by mutual agreement of both parties and following the applicable commercial arbitration rules.

In addition, the user agrees, to the extent permitted by applicable law, not to initiate, join or participate in class action lawsuits associated with any claim, dispute or controversy that may arise in connection with the use of the website and our services. This commitment seeks to promote a more agile and personalized resolution of any conflict, favoring arbitration and individual legal actions over class actions.

 

23. APPLICABLE LAW AND JURISDICTION

Although our services are available in different countries, these terms and conditions shall be governed by and construed in accordance with the laws of the Democratic Republic of Congo. Any dispute relating to these terms shall be subject to the exclusive jurisdiction of the courts of the Democratic Republic of Congo. This applies unless binding arbitration is agreed to in the applicable section.
